“There were no regulations violated by BPKS and other related parties regarding the import of the 250 tons of rice,” said Mualem in his statement, Tuesday (25/11).
Mualem argued that the policy of importing rice from outside was a strategic transition policy that was in favor of the local community.
“One of the things the Sabang city government is facing is the high price of rice when brought from the mainland, which is burdening the community amidst the current economic conditions,” he said.
Mualem also regretted Minister of Agriculture Amran’s statement which was considered too reactionary and lacked regional sensitivity regarding this case, which seemed like a serious action and against the law.
“The illegal statement made by Minister Amran is clearly baseless and reduces the authority of Aceh, especially BPKS with all its authority in accordance with statutory regulations,” he said.
Mualem also urged the Minister of Agriculture to immediately carry out lab tests on the 250 tons of rice according to the statutory mechanism and immediately release it to the people of the Sabang area.
A similar response was also conveyed by the Aceh Chamber of Industry and Commerce (Kadin).He hopes that Amran can respect the authority regarding the trade system in the Sabang Free Zone in accordance with the provisions of the laws and regulations.
“The Sabang area is a trade-free area which is protected by law,” said the Chairman of the Aceh Kadin, Muhammad Iqbal, as quoted by Antara.
As is known, the Minister of Agriculture said that around 250 tonnes of rice imported from Thailand was stored in a rice warehouse owned by a private entrepreneur in Sabang City illegally, because there was no approval from the central government.
Iqbal conveyed that authority regarding trade procedures in the Sabang free zone is mandated by Article 1 paragraph (1) of Law Number 37 of 2000 concerning the Sabang Free Trade Zone and Free Port and Article 167 of Law Number 11 of 2006 concerning Aceh Government (UUPA).
“Because of this, the Minister of Agriculture’s statement is very tendentious and sensitive to Aceh’s relationship with the central government. Moreover, the UUPA revision process is currently underway,” he said.
From the investment side, according to Iqbal, the Minister of Agriculture’s statement could set a bad precedent for the investment climate, especially in Aceh, amidst the Aceh Governor’s incessant efforts to bring in investment, including in Sabang.
A explained that the entry of rice into Sabang had gone through a licensing process issued by the Sabang Area Concession Agency (BPKS).
BPKS, he said, is a central institution that is given authority through Law 37 of 2000, as well as its implementing regulations, namely PP Number 83 of 2010 concerning Delegation of Government Authority to the Sabang Regional Council.
“Regarding this polemic, we will write to President Prabowo regarding investment obstacles in the Sabang area and the Minister of Agriculture’s arrogance in straddling Aceh’s authority, especially in the Sabang free area,” said M Iqbal.
