Christiano, was declared by the panel of judges to be negligent in driving his vehicle, causing a traffic accident which killed the victim. The defendant’s actions are deemed to have fulfilled the elements of Article 310 paragraph (4) of Law Number 22/2009 concerning Road Transport Traffic (LLAJ), as in the first alternative indictment.
“Sentenced the defendant Christiano Pengarapenta Pengidahen Tarigan to prison for one year and two months,” said Irma in her decision, Thursday (6/11).
The panel of judges’ verdict reduced Chrisitano’s arrest and detention period from May 28 2025. The defendant was additionally sentenced to a fine of IDR 12 million, subsidiary to 3 months in prison.
In its consideration, the panel of judges assessed that Christiano had been negligent in driving his vehicle, namely by exceeding the speed limit at the scene of the incident by up to 60 kilometers/hour.
However, the panel of judges also considered that the victim had been negligent, because he did not signal traffic when making a U-turn on his motorbike to the right.
This act which resulted in the loss of the victim’s life was the only thing that was burdensome for the defendant.
Meanwhile, mitigating factors include, the defendant was polite during the trial, was frank, regretted his actions, was still young and expected to become a better person.
“The defendant still wants to go to college, the defendant is the defendant’s hoped-for child. The victim’s parents forgave the defendant before the trial, that the traffic accident was caused by the negligence of both parties and the defendant has never been punished,” explained Irma.
The verdict from the panel of judges was still lighter than the demands of the Public Prosecutor (JPU) who asked that the defendant be sentenced to 2 years in prison and pay a fine of Rp. 12 million, subsidiary to 6 months in prison.
Regarding this decision, both the defendant, through his team of legal advisors, and the prosecutor both expressed their thoughts.
The incident in this case occurred in May 2025.In the indictment read out by the public prosecutor, Christiano, a FEB UGM student, drove his BMW from the south to the north of Jalan Palagan Army Student, Ngaglik, Sleman at a speed of 70 km/hour.
The violent collision occurred when Christiano was about to overtake the Honda Vario motorbike with plate number B 3373 PCG driven by Argo, passing on the right and exceeding the marking line at high speed.
However, at the same time Argo and his motorbike intended to turn back to the right.Because the distance is too close, a collision between two vehicles cannot be avoided.
Prosecutors said Argo fell, while his motorbike bounced and hit another car.As a result of the accident, Argo suffered serious head injuries, a torn upper lip, a bruised left thigh, abrasions on his left hand and died.
