RKUHAP
).
“It is not true that the article which stipulates that the National Police is the main investigator in Article 6 of the RKUHAP has been removed,” said Habib in his statement, Friday (14/11).

The phrase principal investigator in the Criminal Procedure Code is contained in Article 6 which explains the elements of an investigator, which reads, “(1) investigators consist of: a. Police Investigators; b. PPNS; and c. Certain Investigators”.
Then in paragraph 2, “The National Police Investigator as referred to in paragraph (1) letter a is the main investigator who is given the authority to carry out investigations into all criminal acts in accordance with the provisions of the Law.”
Habib admitted that there were plans to remove the phrase.However, because it was in accordance with the decision of the Constitutional Court (MK), the proposal was canceled.
“Indeed, there was a suggestion that this provision be deleted, however, after being reminded that the article was in accordance with the decision of the constitutional court, it was ultimately not removed,” he said.
The proposal to remove the National Police as the main investigator emerged in the RKUHAP discussion meeting ahead of the first level decision making on Thursday (13/11).
Habib explained that the deletion of the phrase was carried out to align the RKUHAP with other laws that were already in effect and their contents were still interconnected.
“Yesterday, we dropped a proposal for an article regarding the highest prosecutor chosen by the president, because that is already regulated in the Prosecutor’s Law. So we will treat the same thing with the National Police, because it is already regulated in the National Police Law, there is no need for redundant regulations here anymore,” said Habib.
The RKUHAP has now been approved at the first level and agreed to be brought to the plenary and passed into law.Habib hopes that the RKUHAP can be passed in plenary next week.
