The State Administrative Court in Hesse announced its ruling that Muslim women cannot become judges or prosecutors if they refuse to remove their headscarves during court proceedings on Monday (1/12).

In an official statement, the Darmstadt court recognized the applicant’s religious freedom as having constitutional weight, it was quoted as saying

However, the court decided that this right was set aside due to constitutional principles and prioritized state neutrality and the freedom of religion of trial participants.
In a court statement, they asked the woman whether she would remove her hijab when interacting in court.
The woman clearly answered that she would not do it.Hesse authorities rejected the request on the grounds that wearing a headscarf conveys a religious symbol during the judicial process and therefore violates the principle of state neutrality.
In addition, according to the court, the use of the hijab in the trial process could also damage public trust in the impartiality of the justice system.
Last October, a court in Lower Saxony issued a similar ruling against women who wanted to become judges while still wearing the hijab.
The Braunschweig Regional Superior Court ruled state law prohibits judges from prominently displaying symbols reflecting political, religious or ideological views during trials.
Religious freedom advocates criticized the ruling, arguing that Germany’s interpretation of state neutrality was discriminatory rather than impartial.
They also said such rulings disproportionately affect Muslim women and create significant barriers to their participation in the legal profession and public service.
