The Indonesian government is currently discussing distribution plans
amnesty
,
abolition
, and rehabilitation for a number of parties that meets considerations of humanity, justice and national reconciliation.
The discussion was held at a Ministerial Level Meeting (RTM) chaired by Coordinating Minister for Human Rights Law Imipas Yusril Ihza Mahendra, Thursday (13/11).
The meeting was also attended by representatives from various ministries and institutions.

Some of them include the Coordinating Ministry for Political and Security Affairs, Attorney General’s Office, National Police, BNPT, BNN, Ministry of Law, Ministry of Home Affairs, and Ministry of Immigration and Corrections.
The discussion includes the group of former Jemaah Islamiyah (JI) members who have disbanded, political prisoners, and suspects in other cases.
“Considering so many requests and hearings submitted, we consider it necessary to hold coordination meetings with several ministries and institutions to obtain input,” said Yusril at his office, Jakarta, this Thursday.
“After the input is given, we will make a summary of this issue and a technical meeting will be held and after that the input and considerations will be submitted for the President to make a decision,” he continued.
Yusril emphasized that the government must be careful in determining who is worthy of receiving state forgiveness.He said, amnesty and abolition are individual, not institutional.
On that occasion, Yusril also highlighted the importance of legal certainty, especially for those who have had suspect status for a long time without further processing.
“Now there is one new person who has written to us and given an audience, namely a number of people who have been declared suspects in a criminal act, but the legal process is pending so there is no clarity and no legal certainty,” he said.
Yusri said the Ministry of Law proposed four categories of amnesty recipients, namely narcotics users, perpetrators of treason without weapons, violators of the ITE Law (insulting the president or head of state), as well as prisoners with special needs such as ODGJ, intellectual disabilities, people with serious illnesses, and elderly people over 70 years.
Meanwhile, the Head of the National Counterterrorism Agency (BNPT), Commissioner General Pol Eddy Hartono, emphasized caution in providing recommendations for perpetrators of terrorism, although he acknowledged that there had been a change in attitude among former Jemaah Islamiyah.
“We continue to be guided by Law Number 5 of 2018. The state does not only punish, but also restores. Since 2024 we have gathered all the emirs of JI and they have declared their loyalty to the Republic of Indonesia,” he explained.
On the other hand, Head of BNN Komjen Pol Suyudi Ario Seto expressed a similar view regarding the plan to grant amnesty to perpetrators of narcotics crimes.
He believes there needs to be a separation between dealers who are part of a network and small players who are not involved in the syndicate.
“We agree that small-scale dealers who are not part of large networks can be considered for amnesty, provided of course that they show good faith and do not repeat their actions,” he said.
The meeting agreed that amnesty and abolition policies must be based on humanitarian considerations, national security and legal certainty without ignoring the victims’ sense of justice.
