Secretary General of the DPP Indonesian Advocates Association (Ikadin) Rivai Kusumanegara said the Draft Criminal Procedure Code (
RKUHAP
) needs to be ratified immediately to avoid legal enforcement chaos.
Rivai said that Law Number 1 of 2023 concerning the Criminal Code (KUHP) will come into effect from January 2 2026, whereas until now the procedural law has not been ratified by the Government and the DPR.

“The new Criminal Code has novelties that are not in accordance with the current Criminal Procedure Code, so there will be chaos in law enforcement,” said Rivai in a written statement, Saturday (15/11).
For example, Rivai explained that perpetrators of abuse, fraud, embezzlement and detention cannot be arrested because certain articles that can be detained under the Criminal Procedure Code still refer to the old Criminal Code.
Rivai explained that problems would also arise in the implementation of social work sentences, cover sentences and supervision sentences regulated by the new Criminal Code because they were not recognized in the old Criminal Procedure Code.
“Similarly, the arrangements for Restorative Justice and corporate crime in the new Criminal Code are not effective because there are no procedural laws yet,” he said.
Rivai understands that the slow ratification of the RKUHAP is due to the pros and cons of a number of articles in it.According to him, in urgent situations it is hoped that all parties can lower their egos and prioritize the interests of the wider community.
“If each person still imposes his views, then the positive things in the new Criminal Code and RKUHAP will not be felt by the public,” he said.
