Indonesian Child Protection Commission (
KPAI
) strongly criticized the actions of preacher Elham Yahya Luqman or
Gus Elham
who kisses children.
KPAI Chair Margaret Aliyatul said this action attacks the dignity of children as individuals who have human rights.
“KPAI considers that this action attacks the dignity of children as individuals who have human rights. Apart from that, this action violates the laws and regulations in force in Indonesia as well as the principles of children’s rights,” said Margaret in a written statement, Thursday (13/11).

He explained a number of rules that conflicted with Gus Elham’s actions.These include the 1945 Constitution of the Republic of Indonesia, Article 28 b paragraph (2) which states that the state recognizes children’s rights to be free from all forms of violence and discrimination.
Then, Law no.23 of 2002 concerning Child Protection in Article 4 which states that every child has the right to live, grow and develop and receive protection from all forms of violence, including sexual harassment and Law Number 35 of 2014 concerning Child Protection (UU PA).
“This action has the potential to be charged with Article 76E which prohibits anyone from committing violence, coercing, or committing obscene acts (indecent acts) against children. KPAI needs to advocate that the interpretation of ‘obscene acts’ be expanded to include acts that violate social and legal boundaries, regardless of claims of good intentions,” he said.
He said violence and sexual abuse against children can have a destructive psychological impact and affect the child’s life in the future, such as causing anxiety, reducing the child’s self-confidence, and affecting the child’s growth and development.
“This situation can damage the child’s mental and physical development and, under certain conditions, can even increase the child’s vulnerability to negative behavior in the future,” he said.
He said the KPI had reviewed the case and identified potential violations of children’s rights.KPAI also reports to the authorities any indications of violations of children’s rights.
“We urge the public not to normalize behavior that violates boundaries towards children and prioritize child safety ethics in every interaction. Encourage the Ministry of Religion to provide guidance to preachers and preachers so that in their da’wah activities they uphold the principles of child protection,” he said.
Gus Elham’s behavior was in the spotlight after photos and campaign movements criticizing his behavior circulated on social media.The campaign movement photo contains a collage of Gus Elham kissing girls.
Many netizens consider this disgusting and inappropriate for someone who is considered a religious leader.However, there are also those who think this is an expression of affection.
Elham has apologized publicly for the way he gave out religious material and for his behavior in kissing young children.
In his statement on his Instagram account @fuadbakh, Elham called the incident a personal mistake and emphasized his commitment to improving himself.
“Assalamualaikum warahmatullahi wabarakatuh. Kediri, 11 November 2025 at 14.00 WIB. With full humility, I am Muhammad Elham Yahya Al-Maliki. I personally apologize profusely to the entire community for the circulation of the video which caused a commotion. I admit that this was a mistake and my personal mistake,” said Gus Elham in the video.
