The decision was read by MKMK Chairman I Dewa Gede Palguna at the hearing of the complaint regarding Arsul Sani’s alleged fake diploma at the MK Building, Central Jakarta, Thursday (11/12).Arsul Sani is present online.

In his considerations, MKMK Judge, Ridwan Mansyur, said that the Honorary Council found that Arsul Sani was legally following the doctoral education process.
Based on investigations, MKMK believes that the diploma document as proof of Arsul Sani’s graduation given by the Collegium Humanum is a genuine and authentic document.
“In other words, from the perspective of the diploma document as the object of the problem, the Honorary Council did not find any falsification of documents in the form of doctoral education diplomas carried out by the Suspected Judge or the actions of the Suspected Judge who used fake documents (diplomas), as if they were genuine, to fulfill the requirements in nominating himself as a constitutional judge,” he said.
Meanwhile, MKMK Judge Yuliandri said Arsul Sani would start the occupation process at Collegium Humanum in August 2025.
He said Arsul Sani had also participated in a doctoral program at the Glasgow School for Business and Society, Glasgow Caledonian University (GCU) in Scotland in September 2010.
“However, the Suspected Judge was unable to complete his studies due to personal busyness. However, the Suspected Judge succeeded in completing part of his studies and was entitled to maintain his grades in some of the courses he had taken, including the ‘Professional Master’ title from GCU,” said Yuliandri.
“When the desire arose to continue his doctoral studies, one of the considerations that was of concern to the Presumptive Judge was whether the university in question ‘recognized’ the value of the courses he had taken at GCU, so that the Presumptive Judge no longer needed to attend similar courses,” he continued.
According to MKMK, from a practical perspective, Arsul Sani’s consideration for continuing his doctoral studies did not conflict with ethical issues.Apart from that, MKMK assessed that before the registration process, Arsul Sani had been careful in making his choice by checking the campus’ reputation via the internet.
“In the view of the Honorary Council, these steps are considered appropriate things to do,” he said.
Yuliandri said that MKMK also discovered facts during the educational process, Arsul Sani submitted dissertation research with the title ‘Re-examining the consideration of national security interests and human rights protection in counter terrorism legal policy: a case study on!Indonesia with focus on post Bal-bombings development’.
According to him, MKMK is not in a position to assess the feasibility of the study or the research results.
Yuliandri said that his party did not find enough evidence to doubt the research process carried out by Arsul Sani.Moreover, according to him, there has been an effort by Arsul Sani to translate his research into Indonesian and publish it as a book with the title ‘National Security and Human Rights Protection: Dialectics of Counterterrorism in Indonesia’ (Kompas Book Publishers, 2023).
“This shows the attitude that the research was carried out seriously and there is a desire to disseminate the ideas to a wider public, not just in the form of dissertation research results written in a foreign language, including English,” he said.
“Considering that based on the facts and considerations described above, the Honorary Council arrived at the conclusion that, in the context of enforcing Sapta Karsa Hutama, the Suspected Judge was not proven to have committed any act which allegedly violated ethics related to falsifying documents or deliberately using fake documents, in the case of doctoral education diplomas, in order to fulfill the requirements as a constitutional judge,” he added.
