(AGO) together with the West Java (West Java) Provincial Government are preparing to implement the punishment
social work crime
for defendants with a criminal threat of less than five years in prison.
Deputy Attorney General for General Crimes Asep Nana Mulyana said he had pressed for an MoU between the West Java High Prosecutor’s Office and the West Java Provincial Government and the Prosecutor’s Office and the regents and mayors in the West Java region.
He explained that this collaboration was an implementation of the social work crime contained in Article 65 letter e of the Criminal Code which was passed on January 2 2023 and will come into effect on January 2 2026.

“The Prosecutor’s Office as the implementer of the Court’s decision is supported by the Regional Government to place social work convicts to carry out mentoring programs in public facilities within the Regional Government,” he said in a written statement, Tuesday (4/11).
Asep explained that social work penalties regulated in the Criminal Code are an alternative to prison sentences carried out in public places.
The aim, he said, is because training in prison has so far been deemed to be less effective, especially for crimes that carry a sentence of less than 5 years.
Asep said that through social work punishment, it is hoped that the convict will be able to become a person who is more useful and has contributed to his social environment or society.
“The form of implementing social work will be adjusted to the needs and suitability in the field. Such as cleaning places of worship or public facilities, providing services to orphanages or social institutions and so on,” he explained.
“Social work punishment is an alternative punishment that trains criminals outside prison, has no elements of coercion, no commercialization, and must comply with statutory regulations,” he added.
Asep said that social work punishment can also provide opportunities for perpetrators to do good to society through useful social activities.
“Because in essence, every human being is not born to make mistakes, but there is always the opportunity to do good and improve,” he said.
