Two expedition service employees were charged with damaging public facilities (fasum) and resisting police officers

The two defendants in question are Arpan Ramdani and Muhammad Adriyan.Both of them were present at the trial of the August demonstration case at the Central Jakarta District Court (PN), Thursday (20/11).

They took part in the demonstration after sorting packages at the Shopee warehouse in Depok.The prosecutor said that both of them wanted to take part in a demonstration at the Kelapa Dua Mobile Brigade Headquarters.This desire was triggered by content on TikTok.
Adriyan then invited Arpan to go to the demonstration location.
“But defendant I Arpan Ramdani refused and did not want to take part, so defendant I Arpan Ramdani and defendant II Muhammad Adriyan did not go to take part in the demonstration or demonstration,” said the prosecutor at the Central Jakarta District Prosecutor’s Office when reading out the indictment at the Central Jakarta District Court (PN), Thursday (20/11).
However, one day later, Adriyan again invited Arpan to demonstrate at the Kelapa Dua Mobile Brigade Headquarters and the DPR/MPR RI Building via WhatsApp short message.Adriyan then picked up Arpan.
The two of them left for the Kelapa Dua Mobile Brigade Headquarters at around 17.00 WIB.However, when he arrived there, there was no demonstration because it had been secured by TNI troops.The two of them then moved to the front of the DPR/MPR RI office.
At 20.00 WIB, Arpan and Adriyan arrived at the Ministry of Environment and Forestry (LHK) near the DPR/MPR Building.Not long after, the two of them joined other demonstrators.
In the indictment, the prosecutor said that Arpan took wood, used plastic drinking water bottles, an orange road barrier measuring 120 cm long, 80 cm high, 50 cm wide at the bottom and 10 cm at the top.
“Where the orange road divider is a public facility belonging to the Transportation Department, as well as dry leaves which were all collected from around the LHK T-junction to be burned using gasoline given by demonstration participants or other demonstrators while saying, ‘Burn it! Come on, go to the damn DPR!'” said the prosecutor.
Meanwhile, Adriyan walked around the T-junction at the Ministry of Environment and Forestry to pick up stones and then throw them at police officers who were providing security, so that the demonstration or demonstration ended in chaos.
The prosecutor said that while carrying out his action, Adriyan also shouted ‘Police are murderers!Demand justice!DPR dog!Disband the DPR!’
The situation escalated and police officers are said to have appealed to demonstrators to stop attacking officers and disperse.
However, the situation became chaotic because the demonstrators did not want to disperse and continued throwing stones at officers and setting fires on the roads and around the DPR/MPR Building.
For their actions, Arpan and Adriyan were charged with violating Article 170 paragraph (1) of the Criminal Code (KUHP) with a maximum penalty of 5 years in prison.
Apart from that, the two of them were also considered to have committed violence against police officers and were deemed to have violated Article 212 of the Criminal Code in conjunction with Article 214 paragraph (1) of the Criminal Code.
The two defendants were deemed to have resisted the police because they did not obey to disperse and were charged with violating Article 216 paragraph (1) of the Criminal Code in conjunction with Article 55 paragraph (1) 1 of the Criminal Code.
“That defendant I Arpan Ramdani and defendant II Muhammad Adriyan did not immediately disperse and continued throwing stones at officers and setting fires on the street and around the DPR/MPR RI Building, even though they had been ordered to disperse three times,” said the prosecutor.
“The actions of defendant I Arpan Ramdani together with defendant II Muhammad Adriyan are regulated and punishable by crime in Article 218 of the Criminal Code in conjunction with Article 55 paragraph (1) 1 of the Criminal Code,” said the public prosecutor.
Apart from that, the two defendants are also considered to have damaged public facilities such as orange road barriers with a length of 120 cm, a height of 80 cm, a bottom width of 50 cm, a top width of 10 cm or road barriers belonging to the Transportation Service and other public facilities.
This is as regulated and punishable by crime in Article 406 paragraph (1) of the Criminal Code in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
